Acceptable Use Policy
1.Purpose
This Acceptable Use Policy (this "AUP") sets out what you may and may not do when using the services provided by COOTOKENS (the "Services"). This AUP forms part of, and must be read together with, our Terms of Service. Capitalised terms have the meanings given in the Terms of Service.
2.Definitions
- Restricted Party means any person that is the subject of sanctions or is otherwise prohibited from receiving the Services, or that is owned or controlled by, or acting on behalf of, such a person.
- Prohibited End Use means any end use that is prohibited or restricted under applicable export control or sanctions laws, including military end uses subject to restriction and the development of weapons of mass destruction.
3.Prohibited Activities
You must not use, and must not permit any end user or third party to use, the Services to:
- (a) Evade export controls or sanctions. This includes misrepresenting your identity, ownership, Ultimate Parent Company or end use; obtaining or attempting to obtain access to capacity that you are not lawfully permitted to obtain; providing or facilitating access by a Restricted Party; or structuring your affairs for the purpose of concealing a prohibited connection or circumventing any export control or sanctions restriction.
- (b) Support a Prohibited End Use. This includes the design, development, production or use of weapons of mass destruction or their delivery systems, and military end uses subject to restriction.
- (c) Create or distribute illegal content. This includes unlawful or defamatory content, and any content that sexually exploits or depicts minors.
- (d) Commit cyber abuse. This includes unauthorised access, malware, phishing, denial-of-service attacks, and interference with systems, networks or data.
- (e) Infringe intellectual property rights.
- (f) Resell or relay without authorisation. This includes reselling, sub-leasing, relaying, reverse proxying or otherwise making available access to third-party model APIs, or operating shared account pools, without our written consent and any required upstream authorisation.
- (g) Circumvent technical controls. This includes attempting to bypass rate limits, region restrictions, authentication or monitoring.
- (h) Commit fraud, money laundering or terrorist financing.
4.Your Declarations
You declare that: your use of the Services complies with all applicable export control and sanctions laws; you have disclosed your Ultimate Parent Company and beneficial owners as required by the Terms of Service; you will not permit any Restricted Party to obtain access; you will not use the Services for a Prohibited End Use; and you will notify us promptly of any change to these matters.
5.Monitoring, Audit and Records
We may monitor use of the Services for compliance, security and operational purposes, and may require you to provide records of your end users, use cases and locations. You must cooperate with such requests.
6.Enforcement
We may suspend or terminate your access immediately where we reasonably believe this AUP has been breached, and we may report suspected violations to the competent authorities. A breach of this AUP may also be a criminal offence under applicable law.
